Court rejects complaint against Karunanidhi

CHENNAI: A sessions court here has rejected a complaint, preferred in 2001, seeking registration of a criminal case against Chief Minister M. Karunanidhi and a vigilance probe into irregularities in the allotment of Tamil Nadu Housing Board plots here.

Principal District and Sessions Judge V. Periyakaruppiah rejected the complaint on Saturday, pointing out that the Directorate of Vigilance and Anti-Corruption (DVAC) had found no prima facie material to register a case.

Direction sought

The complainant, K.C.P. Baskar alias Preethi Baskar, had sought a direction to the DVAC to register a case and investigate the irregularities in the allotment of over 15 TNHB plots at Besant Nagar.

In September 2001, soon after the complaint was preferred, the court directed the DVAC to file a report on the matter.

In its final report, the DVAC informed the court that there were no prima facie materials warranting registration of a case, and that no financial loss was caused to the TNHB.

Referring to the final report as well as a Division Bench order in a related matter, Mr. Periyakaruppiah said, "In this circumstance, the court cannot once again refer the matter to the DVAC under Section 156(3) of the Code of Criminal Procedure for investigation... There is no necessity for proceeding under Section 200 of CrPC to record the statement of the complainant and to order enquiry."

The charge

In his petition, Mr. Baskar alleged that Mr. Karunanidhi had allotted the housing plots to persons close to him, in violation of Section 72 of the Housing Board Act and caused a loss of Rs. 7.5 crore to the exchequer.

Guideline value

According to him, though the market rate and guideline value for a ground of land in 1998-99 was Rs.35 lakh and Rs. 25 lakh respectively, the plots were sold at the rate of Rs. 5.88 lakh per ground.

The beneficiaries included the then MLA Mr. Parithi Ilamvazhuthi, senior police officer Kalimuthu, actor Chandrasekhar, and lyricist Mr. Vairamuthu, he said.
