If not resolved at once, issue can get out of hand Judiciary cannot replace Parliament
NEW DELHI : Accusing the United Progressive Alliance Government of not being serious about the likely fallout of the Supreme Court judgment, which called for a review of all laws incorporated in the Ninth Schedule of the Constitution, the Janata Dal (United) on Tuesday urged Prime Minister Manmohan Singh to immediately convene an all-party meeting to discuss this "sensitive" matter. Addressing a press conference here, party president Sharad Yadav said he had written to the Prime Minister seeking a serious consideration of the emerging situation. While there was no need to change the Constitution as demanded by Tamil Nadu, it was unfortunate the UPA Government had not taken due note of the judgment. "I once again urge the Prime Minister to convene an all-party meeting to sort out the matter with the consensus of all parties and representatives." "I am not saying the judiciary should be deprived of the power to review any government decision but that has to be done within the framework of the Constitution. It cannot take the place of Members of Parliament and replace Parliament.'' Mr. Yadav warned that the situation might flare up with the Tamil Nadu Governor in his speech to the Assembly seeking re-writing of the Constitution.
