NEW DELHI: An Additional Chief Metropolitan Magistrate (ACMM) here on Saturday reserved judgment on a bail application by Maninder Singh Kohli, who is facing extradition proceedings for his deportation to Britain to face trial in the Hannah Foster murder case there. ACMM Kamini Lau reserved her judgment on conclusion of arguments by counsel for the Union Government, A. K. Vali, and for Kohli.
"Liberty unreasonably curtailed"
Counsel for Kohli submitted that the liberty of his client was being unreasonably curtailed due to delaying tactics adopted by the Government. He submitted that the Government had moved the Delhi High Court challenging an order by the ACMM allowing only a part of the additional evidence filed by it in the matter. He submitted that the Government had moved the High Court just to delay the proceedings. The High Court had restrained the lower court from passing any order in the matter till disposal of the Government's petition, counsel for Kohli submitted, adding that his client was suffering for no reasonable grounds. Counsel for Kohli had earlier also opposed the filing of additional evidence by the Government alleging that a fresh investigation was conducted and reports were filed, which was not permitted under the law. Opposing his contentions, Mr. Vali submitted that it was Kohli who was indulging in delaying tactics by filing one application after another. He submitted that his counsel took as many as 40 days to cross-examine witnesses and had so far filed more than 30 applications seeking one or another. Mr. Vali submitted that that the Government had the authority to file additional evidence in the matter at any stage of the proceedings.
Arrested in Kalimpong
Kohli was arrested at Kalimpong in Darjeeling in West Bengal in 2004 and is at present lodged in Delhi's high-security Tihar Central Jail.
