KOCHI: Senior Supreme Court lawyer Indira Jaisingh said here on Saturday that members of the judiciary need to have a vision of a fair and just society while discharging their duties towards the country in a just manner. Delivering the fourth Law Lecture organised by the V.R. Krishna Iyer National Foundation for Law and Social Justice on 'Judicial Activism,' Ms. Jaisingh said judges were not at liberty to deviate from the concept of a just society where justice is ensured for the poorest of the poor. The task of the activist judge was to deconstruct the colonial structure of judiciary that the country inherited and replace it with the democratic structure promised in our Constitution, she said. Pointing out that we cannot dispute the fact that ours is a class-ridden society, Ms. Jaisingh said the question was on which side the judges stood, whether on the side of the rich and the privileged or on that of the poor and the underprivileged. Ms. Jaisingh pointed out that these days, those who oppose judicial activism are very vocal, well-funded and well-organised. Addressing the audience, the former Supreme Court Judge V.R. Krishna Iyer said that speaking the truth was a basic necessity in any democracy. V.R.K. Foundation president K.A. Nayar presided over the function. Foundation secretary M.P.R. Nair introduced Ms. Jaisingh. Treasurer R. Krishna Iyer proposed a vote of thanks.
