Delayed telecast against uplinking guidelines


Interim arrangement violates right to equality Nimbus to file reply by February 9

NEW DELHI: The Delhi High Court on Monday issued notice to Nimbus Communications Limited, owner of Neo Sports, on a Prasar Bharati appeal, which challenged a single judge order directing Neo Sports to share the feed of the ongoing India-West Indies cricket series with Doordarshan seven minutes after live telecast.

A Division Bench comprising Justices M.K. Sharma and Sanjiv Khanna asked Nimbus to file a reply by February 9.

Neo Sports has the exclusive right to telecast the matches being played in India till March 2010.

Challenges interim arrangement

Challenging the interim arrangement of delayed telecast on Doordarshan, Prasar Bharati said it was against the Information and Broadcasting Ministry's uplinking guidelines issued to Nimbus to share the live feed with the public broadcaster. It also violated the fundamental right to equality as it would deny millions of cricket lovers the opportunity to watch the matches.

The court has already allowed Nimbus to market the telecast of the matches on Doordarshan also. Last week it admitted the submission by Nimbus that it would generate more revenue than Doordarshan.

The Nimbus petition challenging the uplinking guidelines will come up before Justice Sanjay Kishan Kaul on February 8.
