MADURAI: Giving a quietus to a public interest litigation petition filed against him, the Chancellor (Governor of Tamil Nadu) of Madurai Kamaraj University has withdrawn the nomination of three professors to the Syndicate. After recording the submissions made by the Special Government Pleader (SGP), appearing on behalf of the Chancellor, a Division Bench comprising Justice Dharma Rao Elipe and Justice P.P.S. Janarthana Raja on Monday dismissed the petition as infructuous. The SGP had produced a letter written by the Governor's Principal Secretary, C.K. Gariyali, to the Vice-Chancellor, P. Maruthamuthu, on January 25. The letter stated that the Governor had directed her to cancel the appointment of the three professors and requested the Vice-Chancellor to recommend three other professors in accordance with the Act. In his petition, G. Sethuraman, Head, Department of History, said that Section 19 of the Act empowered the Chancellor to nominate five members to the Syndicate, of whom two could be of his choice and the rest based on the recommendations of the Vice-Chancellor. But the Chancellor ignored the Vice-Chancellor's recommendations and nominated all five members of his choice, the petitioner alleged.
Counter affidavit
Filing a counter affidavit before the court, the Vice-Chancellor had concurred with the petitioner.
