Residents' front flays Government for not liquidating defunct societies

NEW DELHI: The Delhi Residents' Front, a federation of apartment owners' associations and residents' welfare association, has criticised the Delhi Government for not liquidating the managing committees of housing societies where elections were not conducted as per the rules by December 31, 2006, and as such defunct committees are continuing to run the affairs of the societies despite having no mandate to do so.

In a statement, Front president Sanjiv Kumar said that under the Delhi Cooperative Societies Act, 2003, all societies were to prepare their accounts by April 30, 2005, and then within 180 days or by October 28, 2005, the elections to their managing committees were to be held.

In the event of failure to hold the elections by that date, Section 35 of the DCS Act, 2003, should have prevailed and the managing committees that did not conduct their polls should have ceased to exist.

Notification

But, he said, the term of the defunct societies was extended by two official notifications later in gross contravention of the law.

"A vacuum was thus created,'' Mr. Kumar said, adding that in all those societies where elections were not held there was a period when the managing committee ceased to exist and so no one was legally authorised to manage and maintain the affairs of the society except the administrator appointed by the Registrar. .
