BANGALORE: The Central Bureau of Investigation (CBI) on Monday opposed a bail petition by Zaheer Ahmed Maniyar, an accused in the multi-crore stamp paper racket, on the ground that he is a close relative of Abdul Kareem Telgi, the prime accused in the racket. The Special Public Prosecutor (SPP) of the CBI, B.R. Nanjundaiah, said Maniyar had collected valuable documents pertaining to Telgi and kept the original documents in Mumbai, Athani and other places. He said the documents were seized on June 23, 2003 when the Stamp paper Investigation Team (STAMPIT) was in charge of the case. Maniyar, a resident of Bijapur, he said, was accused no. 20 in the case registered with Madiwala police station and for offences under Section 255, 256, 258, 260 and 420 of the Indian Penal Code. Justice Mohan Shantangouder adjourned hearing on the case.

A Division Bench comprising Chief Justice Cyriac Joseph and Justice B.S. Patil on Monday admitted a petition and ordered issue of notices to Nimbus Communications and other respondents challenging the airing of an advertisement on Neo Sports Television Channel during the one-day cricket match series involving Indian and the West Indies. The advertisement, the petitioners said, was demeaning as it ends with the caption that "It is tough being a West Indian in India." The Bench said the advertisement had been stopped and the first prayer of the petitioners seeking stoppage of the advertisement had become infructuous. On damages, the Bench said such a remedy could not be resorted to in writ petition. It adjourned hearing in the case.

A Division Bench comprising Chief Justice Cyriac Joseph and Justice B.S. Patil adjourned further hearing on a petition challenging an order of the Administrator of the BBMP asking residents to produce additional documents for sanction of plan for residential buildings under the easy plan scheme. The petitioner claimed that under the new order, a person who had approached the BBMP for sanction of easy plan would have to produce an affidavit by the architect and legal opinion. These two documents were not sought when the scheme was introduced. The Bench adjourned the case by two weeks.
Quashed
Justice K.L. Manjunath on Monday quashed the orders of the Deputy Commissioner (DC) and Assistant Commissioner (AC) confirming the sale of six acres of coffee land in Madikeri taluk. The petitioner, CC Transport, said six acres of coffee land it owned was auctioned for recovery of revenue arrears. However, the purchaser had failed to pay the remaining amount within 15 days as stipulated under the law. Yet, the DC and AC had confirmed the sale. Justice Manjunath levied costs of Rs. 5,000 on the person who had purchased the land at the auction and failed to pay the rest of the amount. He quashed the orders of the DC and the AC.
