KOTTAYAM: Against the backdrop of the decision of a Supreme Court Division Bench to the effect that the report of Justice K.K. Narendran Commission is ab initio void and unconstitutional, the valid document on the reservation issue in Kerala was the recommendation of the Justice K.J. Joseph Commission and as such all future appointments should be based on those recommendations, said P.K. Narayana Panicker, general secretary Nair Service Society (NSS). The NSS always maintained that the rich among the reserved communities should be avoided from reservation benefits and Friday's Supreme Court verdict was a victory for the stance taken by the NSS, he said. Mr. Panicker was reacting to the apex court verdict in the case filed by the NSS with the prayer that the recommendations submitted by Justice Narendran on April 11, 2000, and the government order dated May 27, 2000, may be declared ab initio void and unconstitutional and that a permanent commission, as directed by the Supreme Court in its verdict on Mandal Commission Report on November 17, 1992, shall be appointed. Though he had not got the full text of the verdict, it had been made clear that the court said that the report had been set aside, and the writ petition filed by the NSS had been allowed, Mr. Panicker said. If the Government did not follow the Supreme Court judgment, contempt proceedings would be initiated, he said.
