Supreme Court notice to AIADMK, others

CHENNAI: The Supreme Court on Friday issued notice to the AIADMK and others on a Special Leave Petition filed by the Tamil Nadu State Election Commission, challenging two judgments of the Madras High Court on elections to Chennai Corporation. The First Bench, comprising Chief Justice of India Justice K.G. Balakrishnan and Justice R.V. Raveendran, ordered notices to the AIADMK, the MDMK, the BJP and the DMDK, besides some individuals.

The petition contended that the High Court had erred in entertaining writ petitions in election matters.

Consistent view

It said the apex court had taken a consistent view that elections to Parliament, legislature or local bodies could not be called in question except through an election petition.
