NEW DELHI: The Delhi High Court on Thursday upheld the re-nomination of Kapila Vatsyayan as a trustee of the Indira Gandhi National Centre for the Arts (IGNCA) in February 2005. Dismissing a public interest litigation by the IGNCA Employees' Union affiliated to the Centre of Indian Trade Unions (CITU) challenging the re-nomination of Ms. Vatsyayan, a Division Bench of Justice Swatanter Kumar and Justice H.R. Malhotra said there was no merit in it and dismissed it. While issuing notices to the Union Government, the IGNCA and Ms. Vatsyayan, the Court had directed that any further appointment to any posts in the trust would be subject to the outcome of the PIL. The petitioner had submitted that Clause 7 of the IGNCA trust deed provided for a ten-year tenure for a trustee, which in the case of Ms. Vatsyayan began in 1987 and was over in 1997. There was no provision for re-nomination of a trustee in the trust deed after the expiry of the stipulated ten-year term, the petitioner submitted.
