IT Park: A.P. allowed to auction lands

NEW DELHI: The Supreme Court on Monday permitted the Andhra Pradesh Government to sell by auction a portion of the lands acquired for the purpose of development of Information Technology Park.

A three-Judge Bench of Chief Justice K.G. Balakrishnan, Justice P.K. Balasubramanyan and Justice R.V. Raveendran while granting permission made it clear that such sale would be subject to the result of the appeals pending in the apex court. The Bench also directed listing of the appeals for final hearing in the second week of May.

Senior counsel Harish Salve, K.K. Venugopal and others told the Bench that the Andhra Pradesh Industrial Infrastructure Corporation Ltd. had issued an advertisement in an English newspaper on March 2 for the sale of 60 acres out of the total area of about 420 acres. They said that if the Government was allowed to sell the lands, the interests of the land owners would be jeopardised.

Appearing for the State Government, Solicitor General G.E. Vahanvati and Additional Solicitor General Amarendra Saran brought to the notice of the court that the plea of the petitioners for interim relief having been rejected, the present applications should not be entertained. Accepting the submissions, the Bench dismissed the applications.

K. Anjana Devi and others in their applications said that if the Corporation was allowed to transfer the land, in the event of the appeals being allowed by the apex court, they would be deprived of 190 acres of plotted area excluding the area of about 126 acres required to be set apart for roads, hospitals and for other public use. The appellants and other owners had a statutory right to retain and possess the 316 acres of land, they said and sought a direction to the Corporation not to give effect to the auction/sale in pursuance of the advertisement.
