Kakinada: Making an order for appointing a guardian for custody of a minor should be based on the minor's welfare, according to M. Ammiraju, a senior advocate. Addressing the moot court on law of guardians and wards organised as a part of the curriculum at the Rajiv Gandhi Institute of Law here on Tuesday, he maintained that the court would not make an order for the return of a ward to the custody of his guardian unless in the opinion of the court such an order is for the welfare of the minor. He also said that in the choice of the guardian or a minor, the court must be guided entirely by the interests of the minor and the court should select a guardian best suited to secure minor's interest. Mr. Ammiraju said that a child's custody could be entrusted to any person other than the natural guardian if it is necessary. The sex of the child is also a matter for consideration for appointment of a guardian. P.V. Trinath, principal, presided.
