ALLAHABAD: The Allahabad High Court on Tuesday directed the Uttar Pradesh Government to file a counter-affidavit on a habeas corpus petition of a prisoner sentenced to life imprisonment in a murder case. The order was passed by a Division Bench of Justice Imtiyaz Murtaza and Justice Saroj Bala on the petition of one Kamlesh Singh, who alleged that he was sentenced to life in prison by a Sessions judge on September 26 last year without hearing him on the quantum of punishment. The petitioner claimed that since his brother died on the day the judgment was delivered by the lower court, he was not present in the court. An application was also moved for adjournment of delivery of the judgment, but it was rejected and he was sentenced to life term, he contended. -
