Kozhikode: A homoeopathy doctor has initiated legal proceedings against his wife for undergoing Medical Termination of Pregnancy (MTP) without his consent. Anil Kumar, 38, hailing from Puthupannam, near Vadakara in the district approached the Vadakara Judicial First Class Magistrate's Court with a petition against his spouse, Mini, 27, a teacher at Rani Public School at Vadakara, saying that his consent had not been sought for the MTP. Allowing the petition, Magistrate G.R. Bilkul issued a directive to the Vadakara Sub-Inspector of Police to conduct an inquiry in this regard. An order was also passed directing the private hospital in which the MTP was carried out to submit all records pertaining to the abortion. Anil Kumar and Mini were married on February 20, 2005. The couple has a one-and-a-half-year-old child. The wife decided to go in for an abortion without consulting her husband since her pregnancy was preventing her from going to schoolAccording to P.V. Hari, lawyer, if found guilty, the accused would be punished with imprisonment for three years and fine under Section 312 (causing miscarriage) of the Indian Penal Code.
