Admission process can go on: Moily

To Supreme Court order on OBCs "Where did they [the Court] say they were staying the operation of the Act? They have not mentioned it."

CHENNAI: The process of admission of students set in motion by the Central institutions of higher education, providing reservation for the students of Other Backward Classes (OBC), can go on, said the former Karnataka Chief Minister and chairperson of the Oversight Committee on reservation in the Central institutions, M. Veerappa Moily, on Sunday.

Giving his interpretation of the Supreme Court's order in the matter, Mr. Moily told The Hindu over the phone that "there is no need to hold back the implementation of reservation [for the students of the OBCs]" as the Court did not direct that the operation of the relevant clause of the Central Educational Institutions (Reservation in Admission) Act be put on hold.

Referring to the operative portion of the order, Mr. Moily asked:

"Where did they [the Court] say they were staying the operation of the Act? They have not mentioned it." The language used by the Court provided options, not directions, to the Union Government. "It is up to the Government of India [to decide]. If they (the Government) feel that they can hold back the operation of Section 6 (of the Act), they can do so. Otherwise, they can go ahead." [The section pertained to the definition of OBCs.]

Similarly, in respect of determining the broadbased data as stated by the Supreme Court, Mr. Moily, who also headed the Administrative Reforms Commission constituted by the Union Government, referred to the Court's observations on the 1931 Census. In the operative portion, there was no direction to the Government, though the database required to be improved.
