Custody of minor girl: civil court to resolve issue

High Court judge's directive comes on writ plea filed by couple that adopted Vaishnavi

HYDERABAD: Justice L. Narasimha Reddy of the High Court on Wednesday declared that the controversy regarding the custody of a minor girl child, Vaishnavi, pursuant to the decision of the Andhra Pradesh State Women's Commission is to be resolved by a competent civil court.

The judge was dealing with a writ petition filed by the couple, which adopted the two-year-girl child. They complained that the Women's Commission had directed the child to be handed over to the natural parents though the child was given in adoption to them. The judge heard the counsel for the natural parents as well as the couple that had adopted the daughter for over three days and heard the versions of the contesting parties in person in the chambers.

Directive to couple

The judge felt that the contentious issue of the factum of adoption has to be decided by a competent civil court and directed the couple, which had been claiming the custody of Vaishnavi based on adoption to file an appropriate case in the civil court before April 30.

The judge further directed the court to adjudicate the matter within three months. The judge said that for three days in a week the child will stay with the natural parents and for days a week she shall stay with the couple which is claiming adoption. It was made clear that both the couples had to be extra vigilant regarding the tender age of the child and take steps to see that she is not emotionally disturbed.
