Court dismisses former IG's plea

KOCHI: A Division Bench of the Kerala High Court on Thursday dismissed a writ appeal filed against a single judge's verdict refusing to interfere with the criminal proceedings initiated against K. Lakshmana, former Inspector-General of Police, in the case relating to the murder of Naxalite leader Varghese.

The Bench comprising Acting Chief Justice K.S. Radhakrishnan and Justice M.N. Krishnan while dismissing the appeal by Mr. Lakshmana said the matter was being unnecessarily delayed from 2003 at the instance of the appellant.

The court observed that it did not find any reason to keep this matter pending.

The court observed that the single judge had rightly pointed out that it was not fair to consider the material placed before the court at this stage of proceedings and on the basis of the final report submitted by the CBI.

The Bench said that no flexible or rigid standards could be employed by the court while deciding whether the delay entailed denial of the right to fair trial.

According to the CBI chargesheet, the Naxalite leader was shot dead by P. Ramachandran Nair, retired CRPF constable, at the instance of K. Lakshmana, the then Dy. SP, and P. Vijayan, the then DIG, Northern Range.

Defamation case

Justice V. Ram Kumar on Thursday declined to interfere with the defamation case against noted literary critic Sukumar Azhikode instituted by K.V. Joseph, former Special Public Prosecutor in the ice-cream parlour sex racket case at the Kozhikode Sessions Court. According to Mr. Joseph, the remarks of Mr. Azhikode made against him at a meeting held on January 8, 2006, were defamatory.
