Bank told to pay compensation

CUTTACK: A city branch of a nationalized bank came under heavy flak from the Orissa Consumer Disputes Redressal Commission for its highhandedness and serious nature of deficiency in providing service to customers.

The Commission has directed the Chandi Chhak branch of Canara Bank to pay Rs 5000 as compensation for causing mental agony and torture to one of its customers. The bank was also directed to pay another Rs 1000 to the customer towards the cost of the litigation.

Cheque deposited

The case inter alia states that one B Muralidharan Nair of Kerala working here in a private company had opened a savings bank account in the bank and deposited a cheque amounting to Rs 1 lakh to be credited in his account in February 2005.

When the amount was not credited to his account for two months on the flimsy ground stated by the bank that the cheque is `not traceable', Mr. Nair sent the bank a lawyer's notice in April 2005 asking the authorities to credit the amount in his favour within 15 days or else he would take legal recourse.

But the bank neither responded to Nair's plea nor did it take action despite the advocate's notice. Finding no other alternative, Mr. Nair moved the consumer forum.

The State Consumer Commission, holding the bank guilty, asked it to credit the cheque amount to the customer's account with an interest of 9 per cent per annum and pay Rs 6000 towards compensation and litigation cost by May 31, 2007.

"Failing to do so within stipulated time, the bank will be asked to pay the entire amount with 12 per cent annual interest", said the order passed by Commission members Basanti Devi and Subash Mahatab.
