NEW DELHI: A single act of dishonesty and breach of faith by an employee is sufficient to justify his/her termination from service, the Supreme Court has held. The fact that the erring employee was not involved in a similar offence does not in any manner mitigate the seriousness of the offence, a Bench of Justices B. P. Singh and P. K. Balasubramanyan said on Tuesday, while upholding the dismissal order passed by Andhra Pradesh State Road Transport Corporation. The Bench allowed an appeal filed by the corporation challenging a direction of the Andhra Pradesh High Court, which ordered fresh appointment of one B. Swamy, a conductor who was dismissed from service for failing to remit fares collected from passengers. Swamy was caught by a special squad of the corporation for issuing tickets of 50 paise denomination to 16 illiterate passengers though he charged them Rs. 4 per ticket. The High Court however, ordered that Swamy be re-appointed as the punishment was too grave for the offence he was charged with. It reasoned that the employee cannot be dismissed for a single offence as the corporation had failed to prove similar offences against him. The apex court rejected the reasoning and held that it was the duty of the conductor to issue tickets to the passengers. - PTI
