Centre to seek early hearing of quota case

  • IIMs may go ahead with the admission process after April 21
  • Centre has filed an application for vacating stay order

    New Delhi: The Centre will seek on Wednesday early listing of the application for vacating the interim stay on the implementation of the 27 per cent reservation for OBCs in elite educational institutions.

    It will make the request before a Supreme Court Bench of Justice Arijit Pasayat and Justice L.S. Panta.

    The Centre wanted to make the mention on Tuesday itself before Chief Justice K.G. Balakrishnan.

    However, when it learnt that Justice Pasayat and Justice Panta were to sit together on Wednesday, it was decided to ask them.

    Since the IIMs had made it clear to the Union Government that they could not wait beyond April 21 for proceeding with the admission process, the Centre is keen on pressing for an early hearing.

    Passing orders on writ petitions challenging the constitutional validity of the Central Educational Institutions (Reservation in Admissions) Act, 2006, the court stayed the implementation of the law insofar as it pertained to 27 per cent quota for OBCs. The Centre filed an application on Monday for vacating the interim order passed on March 29.

    The Centre is expected to bring to the notice of the court that since the permitted strength in the IIMs, IITs and other Centrally-funded institutions would be increased proportionately, the number of seats available for the general category would not be less than last year.

    It will also plead for referring the matter to a larger Bench.
