Court fiat to States on illegal stay in Government bungalows

Governments asked to explain steps taken for recovery of penal rents for over staying


  • Around 38 unauthorised occupants in Tamil Nadu, 60 in Andhra Pradesh
  • Bench directs listing of matter for further hearing on August 1

    New Delhi: Not satisfied with the steps taken for evicting unauthorised occupants in government bungalows, the Supreme Court on Wednesday directed the Tamil Nadu and Andhra Pradesh Governments to file affidavits explaining proceedings initiated by them in this direction.

    A Bench comprising Justices B.N. Agrawal and P.P. Naolekar gave this direction during the course of hearing of a petition relating to unauthorised occupation of bungalows by VIPs in various States. The Bench heard the States of Tamil Nadu and Andhra Pradesh on Wednesday.

    Amicus curiae in the case, Ranjit Kumar, brought to the notice of the court that there were 38 unauthorised occupants in Tamil Nadu and 60 in Andhra Pradesh. They included IAS/IPS/IFS and other government servants.

    He said though both the States had given the figures of unauthorised occupants, there was no mention about the steps taken for evicting them.

    The Tamil Nadu counsel said 12 cases were pending in the High Court and the lower courts and proceedings for eviction had been initiated against 26 others. The counsel for Andhra Pradesh made a similar submission.

    Expressing displeasure over the replies, the Bench, in its brief order, directed the two States to file applications within 30 days before the High Court and the lower courts seeking disposal of the cases.
