Reservation for OBCs is a basic feature of the Constitution. Therefore a blanket stay on 27 per cent reservation for them is violation of the Constitution. The court should have directed the Centre to exclude the creamy layer and implement the law. Its contention that `you have waited for 57 years, why can't you wait for six more months' is painful. While the judiciary takes suo motu action on so many issues, it wants the people to wait for years for social justice.

Without pronouncing its judgment on the constitutional validity of the law providing for 27 per cent reservation for OBCs in IITs, IIMs and Central Universities, the court has taken shelter behind technicalities such as absence of data on OBCs.

In a country where caste plays an important role, caste-based reservation is the only means to protect the rights of the marginalised sections. It is therefore difficult to isolate the creamy layer although the demand for its exclusion appears just. The court should have taken rest of the factors and the constitutional provisions meant for the protection of the weaker sections into account.

Seeking to expand reservation is not vote-bank politics. It is only an effort to bring talented students belonging to the backward sections into elite institutions. The Centre must make efforts such as amending the Constitution to make 27 per cent reservation for the OBCs a reality.
