High Court stays demolition of houses in Hubli

BANGALORE: The Karnataka High Court on Wednesday stayed demolition of houses in Sagar Colony of Hubli by the Hubli-Dharwad Municipal Corporation (HDMC).

Petitioners M.D. Tadas, Abdul Sannidhi and 16 others said that the HDMC had issued a notice to them under the Karnataka Municipal Corporation (KMC) Act asking them why their houses should not be demolished as they were unauthorised constructions.

Notices

The petitioners said that the notices had been issued to them under Section 321 of the Karnataka Municipal Corporation Act, stating that the unauthorised houses had come up on revenue land.

Appearing for the petitioners, V.B. Sheelevant argued that the Government had already come up with draft legislation on regularising unauthorised or illegal structures.

Moreover, provisions of the KMC Act could not be used for houses constructed on revenue land

Justice V. Jagannathan stayed the notification and adjourned further hearing on the case.
