Probe against Singapore residents stayed

Petitioner has filed a complaint of cheating against them

CHENNAI: The Madras High Court has stayed police investigation into a case against three permanent residents of Singapore, on the basis of a complaint lodged by K.C. Palanisamy, former MP, with Erode police.

Justice K.N. Basha granted the interim stay on the petition filed by Ramasamy Athappan, Gobinath Athappan and Nandakumar Athappan.

Mr. Palanisamy had alleged in his complaint that he sold his company's shares to them for low prices after they assured him that they would bring an investment of Rs. 300 crore. They had failed to do so, he said, adding that they had committed cheating and criminal breach of trust.

The petitioners, however, informed the court that the case was a result of a blatant abuse of process of law. First, the Economic Offences Wing police had rejected Mr. Palanisamy's complaint saying it was civil in nature. Then the former MP filed a private complaint before the Perundurai court seeking a direction for registration of a First Information Report.

The court dismissed the plea, stating that the complaint was "frivolous, absurd and one of civil nature."

Suppressing all these details Mr. Palanisamy preferred a complaint before the Kangeyam court and obtained a direction to file FIR and investigate. The petitioners prayed for an order quashing the FIR.
