Proceedings against Paloli stayed

Legal Correspondent

New Delhi: The Supreme Court, on Wednesday, stayed contempt proceedings initiated against Minister for Local Self Government Paloli Mohammed Kutty by the Kerala High Court for making certain remarks against the judiciary.

A Bench of Chief Justice K.G. Balakrishnan and Justice R.V. Raveendran sought replies from the Registrar of the High Court and the four language dailies which published the statements. The Bench stayed the proceedings after the Minister moved a special leave petition, claiming that he did not make the remarks attributed to him and his unconditional apologies were not accepted by the High Court.

The Minister said he was not under an obligation to tender any apology to the general public as directed by the Kerala High Court since Section 12 of the Contempt of Court Act, 1974, stipulated apology to the court and not to others.

The Minister allegedly made derogatory remarks on the judiciary's integrity at a function organised by the employees union of Calicut University on January 30.

Staff Reporter adds from Thiruvananthapuram:

The Minister expressed his happiness over the latest Supreme Court order.

Talking to reporters here on Wednesday, the Minister said he had tendered an unqualified apology in the High Court for it. ``I will be filing an unqualified apology in the Supreme Court also.''
