Resort granted three days to demolish jetty

KOCHI: The Kerala High Court on Wednesday directed the revenue authorities to grant Ashtamudi Lakes Private Limited in Chavara in Kollam three days time to demolish the boat jetty constructed illegally on the banks of Ashatamudi Lake.

Justice S. Siri Jagan also ordered that if the resort owner did not remove the boat jetty within three days, the revenue authorities could take steps to demolish the jetty. The petitioner contended that the boat jetty was constructed in 1980 by S. Govindakurup, former Mavelikara MLA who owned the property. The ancestral property and the old building on it were converted into a resort by his son G. Venunatha Pillai in 1997. No government land had been encroached upon

Stayed

A Bench of Chief Justice H.L. Dattu and Justice K.T. Sankaran stayed a single judge's order allowing Muthoot Hotels Private Ltd at Kovalam to put up temporary fence in their property built allegedly on encroached Government land.

The interim order came on an appeal filed by the Government against the single judge's order. According to the Government, the petitioners had encroached upon 6.60 acres of Government land.

Plea dismissed

Justice K. M. Joseph has dismissed a writ petition filed by Kodiyathur Cooperative Urban Society in Kozhikode challenging the notice for superseding society. The Government pleader submitted that only notice had been given and the society could explain their stand before the statutory authority, the Joint Registrar. The court accepted the submission.
