Most conditions imposed by Government on Pricol stayed

State had referred industrial dispute to tribunal

CHENNAI: The Madras High Court has stayed most of the conditions imposed by the State Government while referring an industrial dispute at the Coimbatore-based Pricol to a tribunal for adjudication.

Justice R. Sudhakar, vacation judge, stayed the operation of four of the five conditions imposed by the Labour and Employment Secretary, after senior counsel A.L. Somayaji submitted that the impugned order was passed without giving the Pricol management an opportunity to explain the circumstances.

The May 24 order said the management should not give effect to orders transferring six employees to a new plant in Uttaranchal and imposing break in service on 147 workers. It also sought to restrain the management from employing or continuing to employ other workers during the strike period and partial lockout.

While staying the operation of all these provisions of the impugned order, Mr. Justice Sudhakar did not interfere with the other clause under which workmen resuming work in Plant 1 and 3 after strike and lifting of lockout had to give individual undertakings stating that they would maintain discipline and good behaviour and continue to give normal production.
