Assault on advocate: former judge to `ascertain truth'

CHENNAI: The Madras High Court on Thursday appointed a retired Judge of the court, Justice K.P. Sivasubramaniam, to "ascertain the truth" behind the alleged police assault on a disabled advocate in Coimbatore.

The First Bench, comprising Chief Justice A.P. Shah and Justice P. Jyothimani, passing orders on a petition filed by the Coimbatore Bar Association and advocate A.S. Mohamed Rafi, said the Commission would submit its report in two months. The Bench said the decision to appoint the former Judge was taken after the petitioners and the respondents suggested that he be nominated to ascertain truth behind the incident.

Government Pleader Raja Kalifulla told the court that the State Government and the police would extend full cooperation to the Commission and provide all relevant records to it.

Office premises and other facilities would also be made available to the Commission in Coimbatore, he said.

August 13

The Bench then adjourned the matter to August 13 for further proceedings.

Mr. Rafi was allegedly assaulted by personnel of the Gandhipuram police station after he had dashed against a woman police constable in December 2006. The incident led to a prolonged standoff between advocates and police in Coimbatore.
