NEW DELHI: A court here on Monday stayed a trial court's order sentencing a boy to assist policemenin traffic management after he had pleaded guilty in a case of drunken driving. Additional Sessions Judge S.N. Gupta stayed the order handed down by Metropolitan Magistrate Gautam Manan after admitting a revision petition by the Delhi police. The Judge asked for all the records of the case and fixed July 10 as the next date of hearing. In their petition, the police had alleged that the punishment awarded to Deepak Gupta was illegal and beyond the provisions of the law. They argued that Section 279 (rash driving on a public way) of the Indian Penal Code, under which the accused was booked and found guilty, provided for imprisonment of six months or a fine of Rs. 1,000 or both. The court, however, had imposed a fine of Rs. 3,000 that was beyond the prescribed limit, the police contended. Also, the order to assist the traffic police was beyond the provisions of the law and it required specialised training, the police said in their petition. Deepak was booked by the police for driving under the influence of alcohol on February 16. On that day, the police had received a call that a Hyundai Santro car had overturned in D Block of Mayapuri. When the police reached there, they found Deepak trapped inside the vehicle. Three months after the incident, the boy pleaded guilty. The court then awarded him the punishment of assisting the traffic police. On Sunday, Deepak began assisting the traffic police at Paras Chowk. Under the court order, he was supposed to continue with his "assignment" for the next nine days, reporting for duty at 10 a.m. and leaving at 1-30 p.m.
