Non-bailable warrant against Mohanti defective: Orissa

Rajasthan DGP asked to resend warrant after rectification


We will challenge the NBW, says counsel

Mohanti went on leave before Rajasthan police arrived


BHUBANESWAR: The Orissa Government on Tuesday said the non-bailable warrant (NBW) issued against Director-General of Police (Home Guards) B.B. Mohanti, accused of evading arrest in connection with his convict-son jumping parole, was “defective.”

Home Secretary Tarun Kanti Mishra acknowledged that DGP Amarananda Pattanayak received a copy of the NBW issued by a Rajasthan court. Mr. Pattnayak informed his Rajasthan counterpart that the defective NBW could not be executed and asked him to rectify the “legal” mistakes.

“We hope they will work on it and issue a fresh NBW,” Mr. Mishra told mediapersons here.

Once the rectified NBW reaches the Government, opinions of legal experts would be sought before taking action.

The Rajasthan court had issued the NBW against Mr. Mohanti and a bailable warrant against his son Bitihotra Mohanti on June 8 and asked an official in the rank of Superintendent of Police to execute the arrest by July 7.

Counsel for the DGP (Home Guards) Ashok Mohanty said, “We have not received any copy of the NBW as yet.” But “we are going to challenge the issuance of the NBW before a higher forum.”

Last month, a team of the Rajasthan police came to arrest the DGP (Home Guards) but it returned empty-handed as he had gone on medical leave. He, however, joined duty a day after the team left after a four-day stay.

Bitihotra was convicted and sentenced to seven-year imprisonment for raping a German tourist last year. It was alleged that Bitihotra, lodged in a Jaipur jail, was granted bail on an undertaking given his father.
