Government says it can prove the ownership Mosque disputes State’s claim
BANGALORE: The State Government on Tuesday told the Karnataka High Court that the land adjoining a mosque on Hospital Road in Shivajinagar here belonged to it and that it had all records to prove the ownership. In its statement of objections, the State said the ownership of the land vested with it and that it was being used by the Bowring and Lady Curzon Hospital. It said the land was being used to construct a hostel for postgraduate students of the hospital. The court was dealing with a petition seeking to restrain the Government from going ahead with the construction on the land. The petitioners also sought a direction to the Bruhut Bangalore Mahanagara Palike (BBMP) not to register any ‘khata’ relating to the land. The State said the land had earlier housed the residential quarters of the Resident Medical Officer.It said the Public Works Department had started work on the construction of the hostel building. On its part, the mosque disputed the contention of the State and said it was the actual owner of the land. It said the land, bearing survey number, CTS 42, had been handed over to it from the time of Hyder Ali. Justice B.S. Patil adjourned further hearing on the petition to Wednesday.
