Varghese case: former DGP’s plea dismissed

Kochi: The Kerala High Court on Wednesday dismissed a petition filed against the CBI Special Court’s order rejecting the petition of P. Vijayan, former Director General of Police, seeking to discharge him from the case relating to the death of Naxalite leader Varghese.

Dismissing the petition, Justice V. Ramkumar said that the Special Court was justified in dismissing the petition to discharge him from the case after evaluating the material produced and also satisfying himself with the existence of a prima facie case against the petitioner. The former DGP was the third accused in the case. The prosecution case was that Varghese was shot dead by the first accused, Ramachandran Nair, a former police constable, in the forest of Thirunelli, Wayanad, in 1970. It was done on the orders of Mr. Vijayan and K. Lakshmana, former IG, it alleged. The case was registered on the basis of the affidavit filed by the former police constable who died later.
