MADURAI: The Madurai Bench of the Madras High Court on Thursday quashed the preventive detention order, passed under the National Security Act, against Hindu Maha Sabha office-bearer R. Raghavan.
He was one of the accused in a case for damaging the statue of self-respect movement leader E.V. Ramasamy, popularly known as ‘Periyar’, at Srirangam in Tiruchi on December 7.
Wrong mention
A Division Bench, comprising Justice D. Murugesan and Justice T. Sudanthiram, said that the Tiruchi Police Commissioner had wrongly mentioned in the preventive detention order that there was a possibility of the accused coming out on bail, in the criminal case, though there were no materials to prove the contention.
Pointing out that the detaining authority had stated that there was an imminent possibility of the accused being released as the courts granted bail after a lapse of some time, the Judges said that the words “imminent possibility” and “after a lapse of time” could not go together.
Similar orders
The Bench had passed similar orders on June 14, quashing the detention order imposed on five co-accused in the case.
