Try out alternative dispute resolution: A.P. Shah

TIRUNELVELI: Alternative dispute resolution, a mediation method that has proved efficacious in the United States, should be effectively used in India, Chief Justice of the Madras High Court Ajit Prakash Shah said on Saturday.

Inaugurating a workshop for advocates on alternative dispute resolution at Palayamkottai, he said this innovative method, part of the Indian culture for centuries, had recorded a 95 per cent success rate in the United States, where 85 per cent of the disputes were being settled through it.

After it was introduced in the Madras High Court, all court rooms were being used in the evening for mediation, as it could throw up a solution acceptable to both parties, even within a few hours of mediation in some cases.

Of the 38 labour-related cases from Tirupur, 36 were settled immediately through mediation in Coimbatore, he said. “To ensure the success of this revolutionary mechanism, all concerned should extend maximum cooperation.”

Madras High Court Judge P.D. Dinakaran called upon the judiciary to ensure early justice for the common man.
