Court awards Rs. 1 lakh as compensation

BANGALORE: The Karnataka High Court on Thursday came down heavily on the Mangalore police for “brutally” assaulting and robbing a Tempo driver and directed the State to pay compensation of Rs. 1 lakh to the driver.

The court also levied a cost of Rs. 10,000 on the Mangalore police and gave liberty to the driver to approach a civil court for claiming damages.

The court was dealing with a petition by Rajesh of Mangalore who complained that two constables of Mangalore police had assaulted and robbed him of Rs. 4,200.

Beaten up

Mr. Rajesh said he had on June 20, 2005 parked the Tempo in the house of the vehicle owner at Moodbidri and was walking to his wife’s house at Alanger, two kilometres away, when two constables accosted him at around 1 a.m. He said the constables beat him up so severely that his hand was fractured.

Mr. Rajesh said the police neither accepted his complaint nor took action against the constables. He had then moved the High Court for compensation, saying that he had to remain unemployed for some time due to the fracture.

Allowing the petition, Justice Ashok B. Hinchigeri said this was a fit case to award compensation and cited several Supreme Court decisions wherein it had dealt at length issues relating to payment of compensation in cases of police atrocity.
