MADURAI: The Madurai Bench of the Madras High Court on Monday dismissed two writ appeals seeking to quash a 1982 Government Order allotting 25 acres to Bharathidasan University in Tiruchi.
A Division Bench of Justice P.D. Dinakaran and Justice P.R. Shivakumar said the appeals suffered from laches (unreasonable delay in asserting a claim), as a G.O. could not be questioned after 25 years.
According to the appellants, they were the original owners of the land. They filed a civil suit in 1983 on the strength of the ‘pattas’ (land ownership documents) issued by the tahsildar.
After 15 years, the district munsif passed an ex parte decree in their favour on February 3, 1998.
An application filed by the university to set aside the decree was dismissed on February 12, 1999.
