Muslim quota: writs referred to larger bench

Admission to educational institutions will be subject to orders by the larger bench


Hyderabad: The writ petitions filed in the High Court challenging the action of the State Government in providing reservation to some Muslim sub-groups have been referred to a larger bench. The admission to educational institutions under this quota being effected now will be subject to orders by the larger bench.

The Division Bench comprising Chief Justice G.S. Singhvi and Justice B. Krishna Rao on Tuesday heard the preliminary arguments regarding the admissibility of the writ petitions. Several students and Backward Class leaders filed the petitions separately.

It may be recalled that the State Government had accepted recommendations of the A.P. Commission for Backward Classes and created BC E category and carved out four per cent from the open category quota in public employment and educational fields and provided reservation.

K. Ramakrishna Reddy, senior counsel appearing for one of the petitioners, brought to the notice of the court the earlier judgments rendered by larger benches of the High Court on two occasions. The Bench said that it was not inclined to suspend the ordinance and made it clear that all the admissions made to various courses will be subject to the orders to be issued by the larger bench. The Government was granted two weeks to file a counter and the case will be listed after that. The court further made it clear that the students who are getting admission under the impugned ordinance shall be informed about the fact that these admissions are subject to the judgment.
