New Delhi: The Supreme Court on Tuesday directed Orissa to suspend in four weeks 48 government servants who are unauthorised occupants in government bungalows. A Bench of Justice B. N. Agarwal and Justice P. P. Naolekar gave this direction after it was brought to its notice that these officials had not yet vacated. Last year the court had issued notice to eight politicians including former Chief Ministers Hemanand Biswal and Giridhar Gomango (at present MP); Prasanna Acharya (BJD MP), Dharmender Pradhan (BJP MP), Bed Prakash Aggarwal, Prasad Kumar Harichandra, Bijoy Mohapatra and Shambhunath Nayak (all former MLAs) to show cause as to why they should not be evicted. The Bench had directed the State Government to publish the list of 108 unauthorised occupants in all the leading newspapers. It was dealing with a petition relating to VIPs occupying government bungalows in Delhi and other States for a long period and refusing to vacate. The court asked the States to resort to eviction proceedings and to recover arrears of rent including penal rent. When it was pointed out that some officials had retired, the Bench gave liberty to the State to invoke the Pension rules for recovery of arrears, including penal rent. The Government was asked to register a case of trespass under Section 447 IPC against the illegal occupants. Regarding Karnataka, the Bench was informed that 79 illegal occupants, mostly nurses, were overstaying in government bungalows.
