Suggestion made to amend Fifth Schedule

VISAKHAPATNAM: A secret document of the Union Ministry of Mines, dated July 10, 2000 contained the legal advice of the Attorney General suggesting amendment of the Fifth Schedule which provides protection to Girijans, to overcome the Samata case judgment.

(In the famous Samata vs. Government of Andhra Pradesh case, the Supreme Court has stated that the State is also a “person” and hence cannot alienate lands in the Scheduled areas to non-tribal or private industries)

This was mentioned by a retired IAS officer D.V.L.N. Murthy in his report on tribal land issues in Andhra area submitted to the Government but not placed in the Assembly by the Government till now.

The details of the report were obtained by a senior leader of the Bharatiya Janata Party and former Union Minister Ch. Vidyasagar Rao through the Right to Information Act.

The latter made the details public at a press conference here on Wednesday.
