Pension ordered to temporary staff

CHENNAI: The Madras High has ordered payment of pension to two temporary employees, who had put in more than 30 years of service and retired over 10 years ago.

Justice N. Paul Vasanthakumar, allowing the pleas of S. Subramanian and R. Sankaran, said that since the petitioners had more than 30 years of service each, and were allowed to retire on attaining the age of superannuation, they were entitled to pension under the provisions of the Tamil Nadu Pension Rules.

Under the Rules, it is clear that even if a Government servant is appointed temporarily and is holding the post for more than 10 years in a pensionable establishment, then pension is bound to be sanctioned, provided he retired after October 1, 1969, the judge said.

‘Not a charity’

Citing the rulings of the Supreme Court, Mr. Justice Paul Vasanthakumar said, “the sanction of pension to a retired Government servant is not a charity and it is given as a reward for the past services rendered by him.

I am of the view that the petitioners are entitled to pension from the date of their retirement and direction is issued to the respondents to sanction pension. The arrears of the pension shall be calculated and paid within three months.” The petitioners sought to direct the Revenue Department to regularise their services from the date of appointment in the cadre of Office Assistants with all consequential benefits.

While Mr. Sankaran was first appointed peon in November 1954 and later made an Office Assistant, Mr. Subramaniam was appointed Office Assistant in July 1957.

They retired in 1992 and 1995 respectively.
