Court bars allotment of permanent houses to tsunami victims

CHENNAI: The Madras High Court has restrained the Chennai district authorities from going ahead with the allotment of 1,392 permanent houses for tsunami victims at Tondiarpet.

The First Bench, comprising Chief Justice A.P. Shah and Justice P. Jyothimani, directed the authorities “to maintain status quo as of today,” on a public interest litigation petition filed by five tsunami victims living in the temporary shelter in Eranavoor here.

In their interim order, passed on Thursday, the judges also directed the Chennai District Collector to furnish in court the list of the allottees along with their present addresses. The matter was then adjourned to August 13 for further proceedings.

The petitioners contended that through a circular dated June 23, 2007, the district administration had stated that it had decided to allot houses to 991 families living in Tsunami Nagar as of December 2006.

The remaining 401 houses would be allotted on the basis of seniority by age.

List not published

Maintaining that 2,065 families were living in temporary shelters, they said the authorities did not publish the list of 991 beneficiaries. According to them, there were many bogus claimants and benami names in the list. As for a July 4 letter calling for verification of age of victims for the purpose of allotment of the remaining 401 tenements, the petitioners said the authorities need not do such verification now because they already had all details concerning bona fide claimants. All the eligible beneficiaries were issued coupons for receiving relief materials, they said, adding, “it is not known as to why they are calling for verification of age now.”

The petitioners listed the activities of various non-governmental organisations and community representatives after tsunami, and said none of them were consulted by the Government before finalising the beneficiaries eligible for allotment of tenements.

The allotment of permanent houses to tsunami victims is vitiated due to lack of policy or guidelines, transparency, public participation and public notice, they said, and prayed for a stay on the allotment at the site of HLL Nagar in Tondiarpet.

They also prayed for a direction to the Government to frame guidelines for allotment of permanent houses with the participation of the affected community.
