“Fill backlog of SC-ST vacancies before recruiting lecturers”

An estimated 595 backlog vacancies for SCs/STs in 1998

100 of them were filled by December 1998


CHENNAI: Puthiya Tamizhagam president K. Krishnasamy has questioned the legality of the move to recruit 1,000 lecturers to government colleges in the State without first filling the 495 backlog vacancies for SCs/STs.

A Division Bench, comprising Justices S.J. Mukhopadhaya and K. Suguna, disposed of the matter saying eligible candidates could approach the Secretary of the Adi Dravidar and Tribal Welfare Department, who would pass necessary orders.

He contended that in 1998 there were an estimated 595 backlog vacancies for SCs/STs, and only 100 of them were filled by December 1998.

The rest of the backlog posts were still vacant, he said, adding that the posts earmarked for SC/ST candidates could not be taken away or clubbed with any other categories as it would infringe the rights conferred on SCs/STs under the Constitution. He pointed out that the Madurai Bench of the court had quashed a notification issued by Madurai Kamaraj University to fill 103 lecturer posts, because the backlog vacancies meant for the SC/ST candidates had been clubbed with the general vacancies.

He sought to bar the authorities from making any appointments to the 1,000 lecturer vacancies before filling the backlog vacancies of SCs/STs.
