High Court refuses stay on Babloo’s arrest

NEW DELHI: The Delhi High Court has refused to stay the prosecution and arrest of alleged gangster Babloo Srivastava in a case under the Maharashtra Control of Organised Crime Act (MCOCA) registered by the Special Cell of the Delhi police in connection with an alleged extortion racket run by him here between 1983 and 1997.

Babloo moved the High Court challenging his prosecution under the Act following issuance of a production warrant by a court here on July 25. He submitted that he was apprehending his arrest in the case following issuance of the warrant.

Refusing to stay the proceedings or restraining the Special Cell from arresting him, a Division Bench comprising Justice Mukul Mudgal and P. K. Bhasin posted his petition for hearing on August 9. The Special Cell had registered the case last year.

Besides Babloo, it made his accomplice Fazl-ur-Rehman a co-accused in the case.

Babloo is at present lodged in a Bareilly jail in Uttar Pradesh . He was extradited to India from Singapore in 1995. There are as many as 39 cases pending against him.

The jail authorities on Friday produced Babloo in the court of Additional Sessions Judge Ravinder Kaur who remanded him to judicial custody.

The jail authorities on three earlier occasions had failed to produce him on one ground or the other. The High Court last year had acquitted Babloo in the Lalit Suneja murder case, setting aside his conviction by the trial court.
