Constitutional fraud

The unambiguous demand in the editorial “Constitutional fraud in Goa” (July 31) that Governor S.C. Jamir dismiss the Digambar Kamat regime is praiseworthy. But will the Congress allow Mr. Jamir to take appropriate steps to undo the mischief?

Speaker Pratapsinh Rane’s action of not allowing three legislators to vote was shameful. He clearly manipulated the minimum required vote for a simple majority. It is the Governor’s moral responsibility to invite Manohar Parrikar to form a government.

The floor test in the Goa Assembly has violated constitutional and democratic principles. The Congress-led government knew it did not have the requisite majority to win the confidence vote. The Speaker, therefore, adopted a fraudulent method by preventing the rebel legislators from voting. The Governor should immediately intervene to put a legitimate government in place.

Goa has a chequered history of defections and coalition governments, thanks to the wafer-thin majority every political party or alliance has while forming a government. Power alone seems to matter. Only a judicial scrutiny of Mr. Rane’s action can save the State from turmoil and instability.

By holding on to power “come what may,” the Congress will end up losing the people’s faith. If it can convince its MLAs and supporters to feel comfortable sitting in the opposition, its credibility will increase and habitual defectors will learn their lesson. If the Congress wants to claim the Mahatma, it should follow his dictum of morality in politics.

The Congress is foolish in thinking that it can continue in power in Goa by manipulation, which is bound to attract judicial intervention. The Governor, who is the custodian of the Constitution, should intervene and correct this aberration before it is too late.
