Accused wanted to be produced in court to enable him to consult counsel
CHENNAI: A Special Court here has rejected the plea of Abdul Karim Telgi, key accused in the multi-crore ‘fake stamp paper’ scam, that he be produced in court to enable him to consult his counsel.
Opposed
Opposing the ongoing trial through videoconferencing, Mr. Telgi and another accused, Abdul Wahid, had said that they should be produced in court to help them avail of all opportunities provided by the Constitution and the Code of Criminal Procedure.
Dismissing the petition, Special Judge for CBI Cases N. Velu said the jail authorities had stated that they could not produce the accused for reasons that were in accordance with the law. The trial could be conducted, as the presence of the petitioners in the videoconferencing mode was equal to their presence in court.
He said the Supreme Court had declared that if the situation warranted the witnesses could be examined through videoconferencing and trial conducted through the mode.
Mr. Velu said Mr. Telgi had been charge-sheeted in 28 cases, of which judgments had been delivered in seven.
“It seems that in all the cases, trials were conducted through videoconferencing.” If the accused were to be produced in all the courts, the jail authorities would suffer a lot, and the trial would take a long time for completion.
