NEW DELHI: Holding senior advocates R. K. Anand and I. U. Khan prima facie guilty of trying to interfere with the judicial proceedings, the Delhi High Court on Tuesday initiated contempt of court proceedings against them and two other lawyers in the sting operation case that exposed the alleged nexus between defence and prosecution lawyers in winning over an eyewitness in the BMW hit-and-run case of 1999. Initiating the proceedings, a Division Bench of the Court comprising Justice Manmohan Sarin and Justice S. K. Misra also issued notices to the four lawyers, asking them to file replies by September 24 as to why they should not be proceeded against and punished for contempt of court. The Court had on May 30 taken suo motu cognisance of the expose. “We are prima facie satisfied that you — R. K. Anand, I. U. Khan, Sri Bhagwan Sharma and Lovely — have wilfully and deliberately tried to interfere with the due course of judicial proceedings and administration of justice by the courts and your acts and conduct were intended to subvert the administration of justice in the pending trial and, in particular, influence the outcome of the ongoing proceedings,” the Bench said. “The perusal of the transcripts and viewing of the compact discs of the edited telecast as also of the original unedited footage prima facie reveals the meeting of the eyewitness in the case, Sunil Kulkarni, with then Special Public Prosecutor, I. U. Khan, on April 28,” the Bench stated.
