CHENNAI: A city consumer forum has directed a financial institution to issue a “no dues certificate”, and pay Rs. 30,000 as compensation to a person for causing monetary loss and mental agony to him.
T.R. Srinivasan of Royapettah complained to the District Consumer Disputes Redressal Forum, Chennai (North), that he was provided a credit card by SBI Cards and Payment Services Pvt. Ltd with a limit of Rs. 10,000 though he was promised a limit of Rs. 50,000. His request to increase the ceiling was not conceded.
In a monthly statement, an outstanding of Rs. 8,317.24 was shown. There was no transparency in the transaction. He returned the credit card duly cut into pieces and dropped them in the box, as instructed by the opposite parties’ call centre. An officer suggested to him to pay Rs. 7,875 towards the amount paid to another bank against balance transfer and assured him that it would be taken as full and final settlement and a “no dues certificate” would be issued. He was asked to give three cheques in equal instalments. Despite the cheques being realised, the certificate was not given and a further sum of Rs. 5,703.64 was demanded. This amounted to deficiency in service. The Manager, Chennai, and the Managers of Customer Services, New Delhi and Gurgaon of the financial institution were cited as opposite parties.
In its order, the forum Bench comprising president J. Venkatesaperumal and Members T. Kamalakannan and M. Sheela, said the case of the complainant and documents stood unchallenged.
