No discrimination, says apex court

New Delhi: Aziz Ahmed Mohammad Shaikh, sentenced to five-year imprisonment by the Special Judge in the 1993 Mumbai bomb blasts case, has moved the Supreme Court challenging his conviction under the TADA Act.

On Thursday, a Bench of Justices B.N. Agrawal, Tarun Chatterjee and V.S. Sirpurkar assured his counsel that there would not be any discrimination in dealing with the bomb blasts accused.

Counsel said Mohammad Shaikh was the first to file a bail plea in the apex court after Special Judge P.D. Kode began the convictions but his appeal was not taken up.

The Bench listed the appeal for hearing to Friday.

Senior counsel Fali Nariman brought to the knowledge of Chief Justice K.G. Balakrishnan that the criminal appeal filed by actor Sanjay Dutt had not been listed for Friday as indicated by the CJI on Wednesday.

The Bench told Mr. Nariman that the matter would be included in the “mention list” on Friday and not in the regular hearing list.
