Police move High Court to take naxalite into custody

CHENNAI: The Q Branch police have moved the Madras High Court, challenging a Special Court order rejecting their plea to take naxalite V. Sundaramoorthy into police custody.
The Special Court under the Prevention of Terrorism Act (POTA) at Poonamallee had dismissed the Q Branch plea for police custody of Mr. Sundaramurthy on August 9. A Division Bench, comprising Justice F.M. Ibrahim Kalifulla and Justice S. Tamilvanan, ordered notice and adjourned the matter to August 14. In his petition, a Deputy Superintendent of Police of the Q Branch said Mr. Sundaramurthy was arrested in Tirupur on July 9 pursuant to a non-bailable warrant issued by the Special Court.
The court remanded him to judicial custody till August 6 when he was produced on July 11.
On July 25, the agency moved a petition, seeking police custody for the naxal leader, on the ground that he was involved in several extremist and terrorist activities threatening the unity, integrity and security of the nation.
“Long delay”
The Special Judge dismissed the petition, saying the prosecution had sought permission after a long delay and that the prayer in the petition was general.
Assailing the order of dismissal, the Q Branch filed the present petition.
